Terms of Service

Last updated 6 September 2026

These terms govern your clinic’s use of Sounds Klear. By creating an account or using the service you agree to them on behalf of your practice, so please read them before you start entering patient records.

1. Who these terms are between

Sounds Klear (“we”, “us”) is operated from India, and is reachable at support@soundsklear.com. “You” means the clinic, practice or organisation that holds the account, and anyone you permit to use it.

If you are accepting these terms on behalf of a practice, you confirm you are authorised to bind that practice to them.

2. Who may use Sounds Klear

Sounds Klear is sold to healthcare practices, not to individuals for personal use. To open an account you must be a clinic, hospital department, or independent practitioner lawfully entitled to deliver audiology, speech-language or occupational therapy services in India, and you must be at least 18 years old.

3. Accounts, staff and access

You are responsible for everything done under your account. That includes keeping credentials confidential, adding and removing staff promptly when people join or leave, and assigning each person the narrowest role that lets them do their job.

  • Do not share logins between people. Every sign-in and every record opened is written to an access log, and a shared login makes that log meaningless as evidence.
  • Emergency (“break-glass”) access requires a written reason, expires by itself and is permanently logged. Use it only where clinical need genuinely justifies it.
  • Tell us without delay at support@soundsklear.com if you believe an account has been compromised.

4. Your data stays yours

Patient records, clinical notes, audiograms, documents and everything else your practice enters remain your data. We claim no ownership of it and we do not sell it, rent it, or use it to train anything.

We process that data only to provide the service to you, and on your instructions. In the language of the Digital Personal Data Protection Act, 2023, your practice is the Data Fiduciary and we act as a Data Processor. How we handle it is set out in our Privacy Policy, which forms part of these terms.

You can export your data at any time while your account is active, and for a period after cancellation as described in section 9.

5. Clinical responsibility

Sounds Klear is a record-keeping and practice-management tool. It is not a medical device, and it does not diagnose, screen, treat or make clinical recommendations.

It is not registered with the Central Drugs Standard Control Organisation as a medical device, and must not be used as one.

Every clinical judgement remains that of the registered professional making it. Audiogram thresholds, therapy goals, session notes and outcome figures are recorded as your clinicians enter them — the software does not verify them, and displaying a number is not a clinical opinion. You are responsible for the accuracy of what your staff record and for meeting the record-keeping standards of the Rehabilitation Council of India and any other body that regulates your practice.

Do not rely on Sounds Klear for anything time-critical to patient safety. Keep whatever independent clinical safeguards good practice requires.

6. Acceptable use

You agree not to:

  • Upload personal data you have no lawful basis to hold, or that you have not collected in line with the consent requirements described in our Privacy Policy.
  • Attempt to access another practice’s data, probe the tenant separation, or circumvent the role restrictions — whether or not you succeed.
  • Reverse-engineer, resell, sublicense or white-label the service without our written agreement.
  • Use the service to send unsolicited marketing, or for anything unlawful.

Reporting a security flaw you find in good faith is welcome and will never be treated as a breach of this section. Write to support@soundsklear.com.

7. Fees, trial and taxes

  • Every plan begins with a 14-day free trial. No card is needed to start, and nothing is charged during it.
  • After the trial, subscriptions are billed monthly in advance at the plan price shown on our pricing section at the time you subscribe.
  • Prices are quoted exclusive of GST, which is charged in addition at the prevailing rate.
  • We may change prices with at least 30 days’ notice by email to your account owner. If you do not accept a change you may cancel before it takes effect.

Cancellation and refunds are covered separately in our Refunds & Cancellation Policy.

8. Availability and support

We aim to keep Sounds Klear available at all times, but we do not currently offer a contractual uptime guarantee, and no service level agreement applies unless we have signed one with you separately. Planned maintenance will be notified in advance where practical.

Support is by email at support@soundsklear.com. We aim to respond within three working days.

9. Suspension and termination

You may cancel at any time from within the application or by emailing us. We may suspend or terminate an account for non-payment, for a serious or repeated breach of these terms, or where we are required to by law.

Because the data is clinical, we will not delete it abruptly. After cancellation or termination we will retain your data for 30 days so you can export it, then delete it. Tell us sooner if you want it erased earlier. Where a law requires us to keep certain records for longer, we will keep only what that law requires.

10. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for loss of profit, loss of business, or indirect or consequential loss; and our total liability arising out of or in connection with the service in any twelve-month period is limited to the fees you paid us in the twelve months immediately before the claim arose.

You agree to indemnify us against claims arising from data you put into the service that you had no right to hold, or from your use of the service in breach of section 6.

11. Changes to these terms

We may update these terms. If a change materially affects your rights we will give at least 30 days’ notice by email to your account owner before it takes effect. Continuing to use the service after that date means you accept the revised terms.

12. Governing law

These terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the competent courts in India.
